Vicipe Terms and Conditions
Introduction
Welcome to Vicipe – a platform for sharing and monetizing recipes, available worldwide via website (and in future, a mobile app). These Terms and Conditions (“Terms”) govern your access to and use of Vicipe’s services, including all content, features, and functionalities provided on our platform (collectively, the “Service”). By creating an account or otherwise using Vicipe, you agree to be bound by these Terms, as well as our Community Guidelines and other policies referenced herein. If you do not agree, you must not use the Service or create an account. We may update these Terms from time to time to adapt to new features, legal requirements, or other changes; continued use of Vicipe after updated Terms are posted constitutes your acceptance of those updates. These Terms form a binding agreement between you (the user) and Vicipe (referred to as “we”, “us”, or “our”). Please read them carefully and ensure you understand them before using the Service.
Eligibility and Account Registration
Age Requirements: You must be at least 13 years old to use Vicipe. If you are under the age of 18 (or the age of majority in your jurisdiction), you confirm that you have the consent of your parent or legal guardian to use the Service and to accept these Terms . Parents and guardians of users under 18 are responsible for supervising the minor’s use of Vicipe, and by allowing a minor to use the Service, the parent/guardian agrees to these Terms and is accountable for the minor’s activity . Vicipe is not intended for children under 13, and no person under 13 may create an account.
Account Registration: To access most features of Vicipe, you must create a user account with accurate, current information. You agree to provide your real name or a valid display name and any other information we require truthfully, and to keep your information up-to-date. Each user may maintain only one personal account (unless explicitly permitted for business or creator accounts), and you may not impersonate any other person or entity.
Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account . You should choose a strong, unique password and not share it with others. If you suspect any unauthorized use of your account or any breach of security, you must promptly notify us. We are not liable for any loss or damage arising from your failure to safeguard your account information. Vicipe may require certain verification steps (such as email or phone verification) as part of the registration or login process to enhance security.
Eligibility for Use: By registering an account, you represent that you are legally capable of entering into these Terms (e.g. you are not a minor, or if you are, that you have appropriate parental consent as stated above). If you are using Vicipe on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and in that case “you” and “your” will refer to the entity. We reserve the right to refuse registration or access to the Service (for example, if you have previously been banned for violations or if required by law).
User-Generated Content and Ownership
Your Content: Vicipe allows users to upload, post, or share content such as text (e.g. recipes, comments), images, videos, live streams, and other materials (“User Content”). You retain any ownership rights you have in the content you create and share on Vicipe; you own the Content you create and nothing in these Terms takes away your rights . However, by submitting or posting User Content on Vicipe, you grant us and our affiliates a broad license to use that content as needed to operate and improve the Service, as explained below.
License to Vicipe: By uploading or posting any User Content, you hereby grant Vicipe a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, host, store, reproduce, distribute, publish, publicly display, publicly perform, adapt, modify, and create derivative works of your Content for the purpose of operating, promoting, and improving the Service (for example, to display your recipes to other users, to generate thumbnail images, or to feature your content in social media promotions of Vicipe) . This license to us extends to any of our successors or affiliated platforms, and allows us to utilize your content in connection with providing the Service and our business operations. We will not sell your Content to third parties or use it outside of providing and promoting the Vicipe Service without your consent, except as permitted by these Terms .
License to Other Users: When you post content on Vicipe, you also grant every other Vicipe user a worldwide, non-exclusive, royalty-free license to access, view, and use your Content through the Service, including the rights to display, stream, or reproduce your content as enabled by our features (for example, viewing your recipe, sharing your post within the platform, or displaying your video through our embed/player functionality) . This means that other users can engage with your Content on Vicipe (such as saving it, sharing links to it, or incorporating it into platform features like duets or reactions if such features exist), but only through Vicipe’s provided tools and in accordance with these Terms. This license to other users does not grant them any rights to use your Content independently of the Service – for example, another user may not copy your recipe and repost it outside of Vicipe without your permission, unless such use is allowed by an exception under applicable law.
Duration of License: The licenses you grant to Vicipe and to other users for your Content are granted for as long as your Content is available on the Service and for a commercially reasonable period of time after you remove or delete the content . If you delete User Content from Vicipe, or if your account is terminated, Vicipe will stop displaying or sharing that content publicly. However, you acknowledge that (a) due to the nature of internet services, some copies of your content (e.g. cached or backup copies) might persist for a time in our systems, and (b) users who have previously accessed or downloaded your Content may retain copies, and Vicipe is not responsible for such third-party retention. We may retain server copies of deleted content for a period of time in backup archives (but not in a way that is publicly viewable) and as necessary to comply with legal obligations or for legitimate business purposes (for example, keeping evidence of content that violated our policies). The above licenses also survive temporarily for a limited period after removal to allow Vicipe to enforce its rights, investigate issues, or comply with legal processes. These licenses will terminate fully once the content is completely removed from all Vicipe systems and archives.
Your Responsibilities for Your Content: You are solely responsible for any Content that you create, upload, or share on Vicipe. This means you must ensure that you have all necessary rights to your Content, including copyrights, trademarks, or permissions from any third parties depicted or whose work is included. By posting Content, you represent and warrant that: (1) you either own the content (for example, you wrote the recipe, took the photo/video, etc.) or you have obtained all necessary rights, licenses, consents, and permissions to legally post it on Vicipe; (2) your Content is truthful (especially for recipe instructions or ingredient information) and not misleading; and (3) your Content and your posting of it do not violate any law or regulation nor infringe the rights (including intellectual property, privacy, publicity, or moral rights) of any other person. You agree not to upload anything that you know or have reason to believe infringes someone else’s copyright or other rights. Creators should only upload content they made or have authorization to use, and should not upload content belonging to others without permission (e.g. don’t copy another creator’s recipe or use someone else’s photos/videos without proper rights).
Content Removal: Vicipe reserves the right to remove or disable access to any User Content at our discretion if we determine that it may violate these Terms, our policies, or the law, or if it may cause harm to any person, the community, or our platform . This means that if your content is flagged by others or identified by us as inappropriate or harmful, we can take it down. We will endeavor to notify you of the removal and the general reason for it (for example, “removed for hate speech” or “removed due to copyright infringement”) unless we are legally prohibited from doing so or if giving notice could lead to further harm (for instance, if the content is part of an ongoing law enforcement investigation) . If you believe your content was removed in error, you may contact us to appeal the decision, and we will provide a review process consistent with our policies. You also agree to remove any of your Content that you no longer have rights to. For example, if you had posted a video with background music under a license that later expired or was revoked, you must promptly remove that video from Vicipe . Failure to do so may result in us taking it down.
Copyright Policy: We respect intellectual property rights and comply with applicable copyright laws worldwide (such as the U.S. Digital Millennium Copyright Act “DMCA”). If you believe that any content on Vicipe infringes your copyright, you (or your agent) should send us a takedown notice in accordance with our Copyright Policy (available on our site) and applicable law. Upon receiving a valid copyright infringement notice, we will promptly remove or disable access to the allegedly infringing content and notify the content uploader. We also maintain a policy of terminating in appropriate circumstances the accounts of repeat infringers . If your content is removed due to a copyright complaint and you believe it was a mistake or that you have the right to use the material, you may submit a counter-notification as permitted by law. More information on this process can be found in our Copyright Policy (which is incorporated into these Terms by reference). Remember, only post content that you have rights to – this includes recipes copied from books or websites, images or videos you didn’t create, etc., unless you have permission or a legal exception applies .
Feedback: If you choose to provide us with ideas, suggestions, or feedback about Vicipe or how to improve it, you agree that we can use and share such feedback for any purpose without compensation to you, and you irrevocably assign any rights in that feedback to us (or grant us a perpetual license to use it, as applicable). This helps us improve the platform.
Monetization and Payments
Vicipe supports content creator monetization, meaning users may earn money through the platform by sharing content (like recipes) or offering premium content for sale. By participating in any monetization features on Vicipe, you agree to the additional terms in this section, as well as any Monetization Program policies we may publish. Creators who monetize must abide by all applicable laws and regulations and use Vicipe’s monetization tools safely and responsibly .
Monetization Features: We may offer various ways for creators to monetize, such as: (1) Selling Content: you might be able to sell individual recipes, collections (e.g., an e-book of recipes), or exclusive content to other users for a fee; (2) Advertising Revenue Sharing: if Vicipe displays advertisements on your content (e.g., banner ads on your recipe page or short ads on your videos), you may be eligible to receive a share of the ad revenue under a Creator Program; (3) Subscription or Donation Models: we might enable fans to subscribe to your content or tip/donate to you; (4) Traffic-Based Earnings: we could reward creators based on traffic or engagement their content generates (for example, a bonus for trending recipes). The availability of these features and the specific terms (such as eligibility criteria, payout rates, etc.) will be described on Vicipe’s website or Creator Dashboard. Some monetization features may not be available in all regions or to all users (for instance, there might be age or region restrictions in compliance with local laws).
Program Policies and Compliance: If you choose to monetize content on Vicipe, you must comply with our Monetization Policies and any additional Monetization Terms provided . Monetizing users are responsible for the content they monetize and must ensure it meets all requirements. This includes providing honest and accurate descriptions of any content you sell or any benefits you offer to paying users . You may not monetize content that violates these Terms or our content standards (see Acceptable Use Policy below) – for example, you cannot sell or earn money from content that is infringing, hateful, or pornographic. We also prohibit fraudulent or deceptive monetization practices, such as attempting to artificially inflate views or sales, or misrepresenting what a buyer will receive. Vicipe reserves the right to disable or revoke monetization privileges for any user or content that breaches our rules or for any safety/legal concerns. In addition, certain categories of content may be non-monetizable by policy (for instance, extreme violence, certain regulated goods, etc., even if allowed on the platform, might not be eligible for ads or sale – these details will be in our Monetization Policy).
Licensing and Ownership for Sold Content: When you sell a recipe or other content to a user through Vicipe, unless otherwise specified, you are granting that buyer a license to access and use the content for personal, non-commercial purposes. You are not transferring your intellectual property ownership to the buyer. Both you and the buyer must abide by any usage restrictions specified at the time of sale. (For example, if you sell a digital recipe, the buyer generally should not re-distribute it publicly without your permission.) Vicipe may include tools to help you enforce these rights, but ultimately we are not responsible for a buyer’s misuse of your content; any disputes over unauthorized use are between you and the buyer, though we will try to assist as outlined in our policies.
Payments to Creators: If you earn money through Vicipe’s monetization features, we will pay out earnings to you pursuant to our then-current payment procedures. You may be required to register with our third-party payment processor, provide accurate address and tax information, and may need to meet a minimum payout threshold. Unless otherwise stated in separate program terms, all payments to creators are discretionary and conditioned on compliance with these Terms. Vicipe reserves the right to monetize all content on the platform (for example, by displaying ads on or near your recipes or videos), and use of the Service does not guarantee that you will receive any payments . In other words, you are not automatically entitled to revenue just for posting content – only if you participate in a specific program or agreement that provides payments (such as joining a partner program or selling content) will you earn money, and even then, according to the applicable rules. Any revenue-sharing payments you do earn (for example, from ads or subscriptions) will be calculated and paid as described in the program’s terms.
Fees and Commission: When you monetize through Vicipe, we may deduct a service fee or commission from the amounts paid by users. For instance, if you sell a recipe for $10, Vicipe might take a certain percentage (which will be disclosed) to cover transaction fees and platform costs. The remaining amount will be credited to you. All fees or commission rates are subject to change, but we will notify creators of any changes to our fee structure in advance through our platform or by email.
Taxes: You are responsible for determining and fulfilling any tax obligations arising from your monetization activities on Vicipe. Any earnings you receive from us are exclusive of applicable taxes, and you are solely responsible for paying any taxes (income tax, VAT/GST, etc.) owed to government authorities in your jurisdiction related to your earnings . Where required by law, Vicipe (or our payment provider) may withhold taxes from payments to you and remit them to the appropriate tax authority . For example, U.S. tax law may require withholding on certain payments treated as royalties . We will provide you with relevant tax forms or documentation for such withholdings as required by law. You should consult a tax advisor if you are unsure about your tax obligations. By accepting these Terms, you agree to indemnify Vicipe for any taxes, penalties, or claims arising from your failure to pay applicable taxes on your earnings (except taxes on Vicipe’s own income) .
Refunds and Chargebacks: If you are selling content or receiving payments from users, you agree to abide by our refund policy. Generally, all sales of digital content are final. However, in cases of fraud, technical error, or where required by consumer protection law, Vicipe may at its discretion issue a refund to a purchaser. If a buyer legitimately disputes a charge (e.g., through their bank or card issuer) and gets a chargeback, that amount may be deducted from your earnings. We may also reverse a transaction if we determine that you violated these Terms or engaged in misconduct relating to the monetized content. Vicipe reserves the right to recover from you any fees or costs incurred due to refunds or chargebacks of your content, including by offsetting against future payouts.
Monetization Compliance: Keep in mind that monetization is a privilege, not a right. We may require you to undergo an application or verification process to enable monetization, and not all who apply will necessarily be approved. You must provide any information or documentation we reasonably request (for example, proof of identity, bank account info, tax forms) for payout and compliance purposes. Monetization features may also carry additional requirements (such as a minimum follower count, content quality standards, or community guideline history). We may suspend or terminate your ability to monetize if you violate any part of these Terms or applicable law, or if we suspect fraudulent or harmful activity. For example, posting plagiarized recipes or using bots to inflate traffic are grounds for removal from monetization programs. Monetizing users are expected to adhere to higher standards of trust and transparency, since they are asking others to pay; failure to do so can result in penalties including loss of earnings or account termination .
Acceptable Use Policy
By using Vicipe, you agree to engage in a respectful and lawful manner. We strive to build a positive community for sharing recipes and related content, so we have certain rules about what you can and cannot do on our platform. You must not use the Service for any illegal, harmful, or abusive purpose , and your Content and conduct must comply with this Acceptable Use Policy (as well as any additional Community Guidelines we publish). Below is a non-exhaustive list of prohibited activities and content on Vicipe:
Illegal or Harmful Content/Activities: You may not post or transmit any content that is illegal to possess, publish, or share in any applicable jurisdiction. This includes content that exploits or endangers minors, instructions for violent or criminal behavior, human trafficking, or any other material that violates the law. You also may not use Vicipe to commit any unlawful act (e.g., fraud, money laundering, gambling operations not permitted by law, or the sale of illegal substances). Essentially, do not use Vicipe for anything illicit or malicious .
Intellectual Property Infringement: Do not upload or share content that you do not have rights to. This means no posting of others’ copyrighted material without permission, no trademark infringement (e.g., using someone else’s brand or logo in a way likely to confuse others), and no sharing of pirated content. For example, do not post recipes copied verbatim from a copyrighted cookbook or images/video clipped from a TV show unless you have permission or a legal exception. As noted, creators should only upload content they made or have authorization to use . Using someone else’s content without permission can lead to removal and repeat offenses can lead to account termination .
Harassment and Hate Speech: Vicipe prohibits content that harasses, bullies, or threatens others. You must not use derogatory slurs, engage in targeted harassment, or encourage others to harm someone. We also do not allow hate speech – content that attacks or demeans a group or individual based on attributes such as race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other characteristic that is protected under law. Keep interactions civil and respectful; healthy debate about recipes is fine, but personal attacks are not. Any user found to be engaging in harassment or hate speech may have their content removed and face suspension or termination.
Violence and Extremism: Explicit or graphic depictions of violence are not allowed, especially if intended to shock or promote harm. You may not post content that glorifies terrorism, organized violence, or extremist ideologies. While discussions of food involving meat or hunting might inherently involve animals, please ensure any such content is presented in a respectful, non-gratuitous manner. Absolutely no content that encourages violence against anyone. Content that includes violent scenes (for example, butchering in a recipe context) must be clearly educational or documentary. Any promotion of violent organizations or extremist propaganda is strictly forbidden .
Obscene or Sexual Content: Vicipe is not an adult content platform. Do not post pornography or sexually explicit material. Nudity is generally not allowed unless it is non-sexual and contextually appropriate (for example, an artistic image or a breastfeeding educational video may be allowed if properly labeled, but lewd or sexual nudity is prohibited) . Recipes themselves typically wouldn’t involve sexual content, but any user avatars, live streams, or messages that are sexual in nature should be avoided. Sexual content involving minors is absolutely banned and will be reported to law enforcement.
Privacy and Personal Data: Do not post personal or sensitive information about others without consent. This includes personal data like phone numbers, addresses, ID numbers, financial information, or private communications. Doxxing (publishing private info to harass someone) is forbidden. Respect everyone’s privacy. Also, do not collect or harvest personal data from other users (for example, scraping users’ email addresses) without our permission.
Impersonation and False Information: You may not impersonate any person or organization you are not. Parody or fan accounts must be clearly labeled as such to avoid confusion. Do not falsely state or misrepresent yourself (e.g., claiming to be a professional chef or nutritionist if you are not). Additionally, while creative storytelling is welcome, do not spread misinformation that could cause harm – for example, posting blatantly false food safety information or health advice related to recipes could be dangerous. We may remove or label misinformation, especially in domains like health or safety. In short, be truthful and clear about who you are and the nature of your content.
Spam and Malicious Activity: You agree not to use Vicipe for spamming or phishing. This means no posting repetitive or irrelevant comments or messages to users, no posting links with the sole aim to drive traffic off-platform (especially to scams or ads), and no using automated scripts or bots to artificially boost engagement. Do not upload viruses, malware, or any other code that could harm the Service or users (for example, no posting of malicious links or software downloads that could compromise user security) . Any attempt to hack, gain unauthorized access to, or disrupt the Service (including attempting to bypass our content filters or security measures) is strictly prohibited.
Prohibited Transactions: You may not use the platform’s communication or content features to engage in transactions that violate law or these Terms. For example, using Vicipe to advertise the sale of regulated or illegal goods (like illicit drugs, certain weapons, etc.) is not allowed . Also, you cannot use the platform to facilitate activities like gambling or lotteries unless explicitly authorized . If you are selling a recipe or service, ensure it’s within legal bounds (e.g., no selling adulterated food products or hazardous materials via our platform).
No Exploitation or Deceptive Practices: Do not exploit other users. This includes any form of scam, such as pyramid schemes, multi-level marketing recruitment on the platform, or “get rich quick” schemes . You also must not deceive users (for instance, posting a recipe that secretly installs malware, or running a fake contest to harvest personal info). All promotions or contests you run on Vicipe must be genuine and follow our rules and any applicable laws.
Community and Interaction: Treat fellow users with respect. If the platform includes real-time interaction (comments, messaging, live chat during streams), the above rules on harassment, hate, spam, etc., all apply equally in those contexts. Additionally, do not flood chats or disrupt live streams. If someone blocks you or asks you to stop contacting them, respect that. No means no in terms of unwanted interaction. Vicipe may implement features to report or block abusive users – use these tools if needed and do not attempt to circumvent someone’s block or our moderation actions.
This Acceptable Use Policy is critical to maintaining a safe and welcoming community. Content or behavior that violates these rules may result in content removal, account suspension, or other enforcement actions. In many cases, we will attempt to educate users on our standards (for instance, issuing warnings or strikes for a first-time minor offense) , but severe or repeat violations can lead to immediate termination of your account. We also cooperate with law enforcement for any unlawful content or conduct on the platform.
Compliance with Laws: Because Vicipe is a global service, you agree that you will comply with all applicable local, national, and international laws and regulations in your use of the Service . Different countries have different rules about online content, data, privacy, and speech. It is your responsibility to ensure that your activities are lawful in your jurisdiction. You also agree not to engage in or promote any activity that would make us violate any law or regulation. For example, if you reside in a country subject to certain trade restrictions or sanctions, you must not use Vicipe in a way that would cause us to break export control or sanctions laws . We may restrict access to the Service in certain jurisdictions as needed to comply with legal requirements.
AI-Generated Content
Vicipe may incorporate Artificial Intelligence (AI) features or content. This can include AI-generated recipes or suggestions, automated translations, AI-powered chatbots, image recognition for tagging ingredients, or other machine-learning tools to enhance user experience. Additionally, some user-generated content on Vicipe might be created with the help of AI (for example, a user could use an AI tool to draft a recipe or edit a photo). It is important to address how AI content is handled:
AI Content Disclaimer: Content generated by AI on Vicipe is provided on an “as-is” experimental basis . AI is a powerful tool, but it is not perfect and can sometimes produce incorrect or misleading information. You acknowledge that any suggestions, recipes, or information provided by an AI feature (such as an AI-generated recipe or cooking advice) are for general informational purposes and should not be relied upon as professional advice or absolute fact . For example, if an AI suggests a certain cooking temperature or ingredient substitution, you should use discretion and common sense before following it. Always double-check critical information (especially related to food safety, allergens, or nutrition) from reliable sources. Vicipe does not guarantee the accuracy, quality, or suitability of AI-generated content . By using AI features, you agree that you understand the inherent limitations of AI technology.
User Responsibility for AI Use: If you utilize AI tools on Vicipe (say, an AI helper to draft your recipe text), you are still responsible for the content that you publish. You should review and edit AI-generated outputs before posting to ensure they comply with our rules and are accurate. Do not blindly post AI content that may contain prohibited material (e.g. the AI might inadvertently produce text that violates our Acceptable Use Policy—such as an offensive phrase or someone’s personal data). You must not use Vicipe’s AI features to generate content that you are prohibited from posting (for instance, you cannot ask an AI to produce hate speech, or illegal instructions, etc.). Such misuse of AI features is a violation of these Terms just as if you created the content manually .
Disclosure of AI-Generated Content: In certain cases, we may require that AI-generated content be labeled or disclosed. For example, if you post an AI-generated image or a deepfake video, we might require you to clearly label it as such to avoid misleading other users (some platforms like Meta require labeling of photorealistic AI content for transparency). We will provide guidelines when this is necessary. Particularly, any AI-generated content that impersonates or simulates a real person (especially any public figure or another user) must be clearly disclosed as not real, and even then, it may be disallowed if it could be harmful or deceptive.
No AI Guarantee: We strive to implement AI features responsibly, but we make no warranties regarding the AI functionality. The AI might not always be available, and it might evolve over time. We may limit usage (for example, a maximum number of AI queries per day) to ensure system stability. Also, any data you input into an AI feature (like typing a query or uploading an image for analysis) is subject to our Privacy Policy and may be stored or processed to improve the AI. Unless you opt out (if such option is provided), we may use your inputs to the AI and its outputs to improve our services (this is common practice: e.g., some AI platforms use user inputs to train and refine their models) . We will not, however, use your private data from AI interactions for marketing or share it with third parties without your consent, except as allowed by our Privacy Policy.
Liability for AI Content: Vicipe disclaims all liability for any harm or losses that may arise from your reliance on AI-generated content . For instance, if an AI-generated recipe suggests an incorrect ingredient that ruins your dish or an unsafe canning method that causes illness, Vicipe is not liable for the consequences. Always use your best judgment and, when in doubt, consult authoritative sources especially on matters of health and safety. By using the AI features, you agree that you assume all risk for any actions you take based on AI outputs . Moreover, you agree to indemnify Vicipe for any third-party claims arising from your use of AI-generated content (for example, if you publish an AI-written article that unknowingly defames someone or infringes copyright, and that person then sues, you are responsible for the claim, not Vicipe) .
AI and Moderation: We also use AI and automated systems in our content moderation efforts. This means some content might be flagged or removed by an algorithm. While we strive for accuracy, AI moderation is not foolproof. If you believe our AI moderation removed your content in error, please contact us for a human review. We continuously train and improve our moderation tools to reduce mistakes.
In summary, AI is a tool that can enhance your experience on Vicipe, but it comes with limitations. Treat AI as an assistant, not an oracle of truth. Vicipe will not be responsible for what the AI says or does – use it at your own risk and with a critical eye .
Messaging and Communication Features
Vicipe may offer communication features such as direct messaging between users, group chats, commenting on posts, or live chat during streaming. These features are intended to help users share tips, give feedback, and build community. By using any messaging or interactive feature on Vicipe, you agree to the following:
No Abuse or Harassment: All rules outlined in our Acceptable Use Policy regarding harassment, hate speech, and inappropriate content fully apply to private messages and live chats as well. Just because a conversation is private or ephemeral does not mean our rules are relaxed. You must not threaten, harass, or demean others via messages. If someone is abusing the messaging feature, please report it; we have zero tolerance for harassment.
No Spam in Messaging: You are not allowed to use messages to spam others – e.g., sending mass unsolicited promotional messages, chain letters, or repetitive content. You also may not use messaging to advertise businesses or other platforms unless the recipient has explicitly consented or asked for that information. For example, do not cold-message a bunch of users with a link to your off-site blog or store; this can result in suspension of your messaging privileges.
User Privacy in Messages: Respect privacy when communicating. Do not share someone else’s private message or personal information without permission. While we don’t routinely monitor private messages, they are not absolutely private – for example, if someone reports a message for violating these Terms, we reserve the right to review it. Use care in what you share via messages. Also, be aware that the person you’re chatting with could screenshot or share your messages; Vicipe isn’t responsible for what recipients do with the content you send them.
Messaging Safety: Be cautious when interacting with others. We do not conduct background checks on users, so use common sense—don’t reveal sensitive personal info to strangers. If you decide to meet someone in person or engage in a transaction due to a connection on Vicipe (for example, meeting up to collaborate on a recipe), understand that we do not vet users and you undertake such interactions at your own risk. Vicipe is not liable for any personal or financial harm that results from user-to-user communications or meetings outside the platform; you are responsible for your own safety.
Live Streaming and Real-Time Interactions: If you host a live stream or live chat on Vicipe, you are responsible for moderating the content of your stream to the extent possible. You should follow our rules in your spoken or shown content, and also use provided tools (such as chat filters or moderators) to keep the live chat civil. As a viewer, if you participate in live chat, the same standards apply: no harassment, no spam, etc. Content in live streams is subject to the same removals and strikes as other content . We may terminate a live stream that is in progress if it flagrantly violates our rules (for instance, if someone is broadcasting illegal activity or explicit content).
No Impersonation in Communication: When communicating on Vicipe, do not pretend to be someone you are not. This includes not only impersonating celebrities or public figures, but also other community members or Vicipe staff. Official Vicipe staff will have a special badge or indicator; if someone in messages claims to be an employee and asks for your account information or password, be skeptical and report it. We will never ask for your password via chat.
Message Content and Moderation: Although we generally consider direct messages to be private between the participants, Vicipe may access and review communications if we have a good faith belief that it is necessary for safety, legal compliance, or to enforce these Terms (for example, if we receive reports of serious harassment or threats in DMs, or we need to investigate spam or scams). We use automated systems to detect certain abusive behaviors (like known child exploitation content or malware links) in messages and may block or remove such content. By using our messaging features, you consent to this limited monitoring and moderation. We aim to maintain user privacy, but we cannot guarantee absolute confidentiality of communications – for instance, a determined hacker or a legal subpoena could potentially access messages. See our Privacy Policy for more information on how we handle user communications.
In summary, treat messaging on Vicipe as you would any other interaction on the platform: with respect for others and adherence to the rules. If messaging or live chat features are misused, we may suspend your ability to use those features or take other action as needed to protect our community.
Content Moderation and Enforcement
Vicipe is committed to enforcing these Terms and our policies to maintain a safe and welcoming environment. By using the platform, you acknowledge and agree to our rights to moderate content and users. Key points regarding enforcement include:
Reporting and Flagging: Our platform typically provides tools for users to report content or behavior that they believe violates our Terms or Community Guidelines. If you encounter content that is harmful, infringing, or otherwise prohibited, you can report it to us. We will review reports and take appropriate action. False or malicious reporting (deliberately reporting innocent content to harass someone) is itself a violation of these Terms.
Removal of Content: As noted earlier, we reserve the right to remove any content that breaches these Terms or that may cause harm to users, third parties, or Vicipe itself . The determination of whether content is violative or harmful is at our sole discretion, though we will make efforts to apply our policies fairly and consistently. In some cases, we may remove content to comply with local law even if it might not violate our general policy (for instance, if a government orders us to remove content that is illegal in that country – see “Legal Compliance” below).
Account Suspension or Termination (By Vicipe): Vicipe reserves the right to suspend or terminate your account or access to all or part of the Service if we, in our reasonable judgment, determine that: (a) you have materially or repeatedly violated these Terms or our guidelines; (b) we are required to do so to comply with a legal obligation or a court order; or (c) your conduct is suspected to be fraudulent, abusive, or could create liability or harm for other users, third parties, or Vicipe itself . In less severe cases or first-time violations, we might opt to suspend your account temporarily (preventing you from accessing certain features or posting new content for a set period) or issue a warning, rather than terminating outright. We will inform you of the suspension or termination and the general reasons for it, unless legal or safety considerations prevent us from doing so . Please note that if your account is terminated for violations, you may be prohibited from creating a new account. Attempting to circumvent an account ban (for example, by creating a new account under a different name) is a further violation and such accounts will be terminated when discovered .
User Termination: You have the right to stop using Vicipe at any time. You may delete your account through the account settings page (if available) or by contacting customer support with a request for deletion. Upon account deletion, we will deactivate your profile and stop displaying your content. As described earlier, we will make commercially reasonable efforts to delete your personal data and content, but copies may persist for a time in backups or if your content was shared by others. Certain data may be retained if necessary for legal compliance or legitimate business purposes (see Data Retention in our Privacy Policy). If you simply stop using your account without formally deleting it, note that these Terms will continue to apply to any cached or stored content until it’s removed, and we may eventually deem an inactive account to be abandoned and delete it after a very long period of inactivity (per our policies).
Appeals: If you believe a moderation action (such as content removal, strike, or account suspension) was mistaken or unfair, you can appeal through the process we provide (typically by contacting us or filling out a form). We will give your appeal a fair review and reinstate content or access if appropriate. However, repeated frivolous appeals or harassing our staff through the appeals process can result in loss of appeal privileges. Our decision on appeals is final.
Three-Strikes or Similar Policy: We may implement a “strikes” system for certain violations, similar to how YouTube operates . For instance, minor first offenses might result in a warning (1st strike), a second offense could be a temporary posting ban (2nd strike), and a third offense within a certain timeframe might lead to permanent account termination (3rd strike). The details of any strikes system will be described in our Community Guidelines or Enforcement Policy. Note that some egregious violations may skip strikes and result in immediate termination (for example, posting child exploitation content is grounds for instant ban and report to authorities without a warning or strike).
Legal Compliance and Removal Requests: If we receive a request from a law enforcement agency or a court order (or equivalent legal mandate) to disclose user information or remove content, we will comply to the extent required (after verifying the authenticity of the request). Additionally, if content is alleged to violate someone’s legal rights (e.g., defamation or privacy rights) or local law, we might restrict it regionally. For example, if a certain post is ruled illegal in Country A, we might make it unavailable to users in Country A. We also have a process for government or court-ordered content removals which will be described in our Transparency Report or policy documents (similar to how platforms handle “Legal Removals” ). Vicipe strives to balance compliance with protecting users’ expression, but in all cases, obeying the law is paramount.
No Liability for Enforcement: You agree that Vicipe is not liable for any consequences of our decisions to moderate, remove, or not remove content. The decision to take down (or leave up) user content is at our discretion, and we provide the Service “as is” – meaning we do not guarantee we will take action on every issue users report . For example, if we fail to remove some content you find offensive, or if we remove your content that you believe should have stayed, you cannot hold us legally responsible for the impacts of those decisions. We provide a platform and will make good faith efforts to enforce our rules, but the final editorial and operational judgment is ours.
Repercussions of Termination: If your account is terminated, these Terms will continue to apply to you in certain ways. Specifically, any provisions of these Terms that by their nature should survive termination (such as intellectual property licenses granted to us, indemnification, warranty disclaimers, limitation of liability, etc.) will remain in effect . After termination, you are not allowed to access or use the Service on any account. If you had any outstanding obligations (like owing us money for any paid services, or needing to ship a promised reward to someone if that feature exists), those obligations survive and you must still fulfill them.
Community Involvement: We encourage users to be part of the solution. Maintaining community standards is a shared effort – please uphold the rules and report bad actors. We may also engage trusted users in programs to help moderate (for example, some platforms have volunteer moderators or community “ambassadors”). If you are chosen for such a program, you must follow all guidelines provided to you, and understand you are not an employee but a volunteer; we appreciate your help but also reserve the right to revoke any community moderation privileges if abused.
In summary, Vicipe has the right to enforce these Terms at its discretion to protect the platform and its users. We will act in accordance with these Terms and our policies, and aim to be fair and transparent in our enforcement. However, in all cases, our judgment on content and conduct is final, and by using Vicipe, you accept our authority to make these decisions.
Intellectual Property of Vicipe
While users retain rights to their own content, all rights in and to the Vicipe Service itself and the content provided by Vicipe are owned by us or our licensors. This includes the platform’s design, software code, databases, the Vicipe name and logo, trademarks, the AI models and algorithms we use, and any text or media content that is generated by us (such as any original editorial content, banners, or templates we provide). These are protected by copyright, trademark, and other intellectual property laws.
Limited License to You: We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service and Vicipe’s content for its intended purpose – i.e., for you to view and interact with recipes and related features, in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of our software, unless such actions are permitted by law or you have our written permission . For example, you cannot scrape our site en masse to create a competing database of recipes, and you cannot use our app’s code in your own application without permission. Similarly, you may not use Vicipe’s trademarks (like the name Vicipe or logos) without our prior written consent, except as allowed by fair use or as part of referencing the Service (e.g., saying “Check out my recipes on Vicipe” is fine, but creating a product that implies endorsement by Vicipe is not).
Third-Party Content: If Vicipe displays or uses any content owned by third parties (e.g., a library for a video player, stock images, or a partner’s content), such content may be subject to their own terms. We often include open-source software in our service; any open-source components are licensed under their own licenses, which may override some of these Terms where applicable (for instance, an open-source library used in the app might allow you certain rights to that library’s code). We will provide attributions or notices for third-party or open-source materials as required. Nothing in these Terms limits your rights under an open-source or other third-party license.
Feedback and Contributions: Any code, content, or suggestions contributed to Vicipe by users (outside of the standard content posting covered earlier) – for instance, if you help us improve the platform via code contributions or you participate in a beta test – may be subject to separate agreements. Absent a specific agreement, by contributing such material you grant Vicipe all necessary rights to use and incorporate it into the Service without obligation.
Takedown Notices for Vicipe IP: We reserve all rights not expressly granted to you. If you misuse our IP (for example, use our logo without permission or clone our UI), we may take legal action. Conversely, if you believe Vicipe or someone on Vicipe is infringing your intellectual property (apart from copyright which is covered above), you can notify us with relevant details, and we will investigate and respond as appropriate, which might include removal of infringing material or other remedies.
Brand Usage: If you want to use the Vicipe brand or assets in a way outside the standard functionality (like in a news article, video review, etc.), please consult our brand guidelines (if available) or contact us for permission. We generally permit users to create content about Vicipe (like tutorial videos or blog posts) under fair use, but you cannot imply our sponsorship or endorsement without a formal partnership.
Disclaimer of Warranties
Vicipe is provided “AS IS” and “AS AVAILABLE”. We make no guarantees that the Service will be always available, uninterrupted, or error-free . To the fullest extent permitted by law, Vicipe disclaims all warranties and representations, express or implied, regarding the Service and content on the Service. This includes, but is not limited to: implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that might arise from a course of dealing or usage of trade . We do not warrant that the Service will meet your specific requirements or expectations; for example, we do not guarantee that you will gain any particular benefit or audience by using Vicipe, or that your experience will be the same as any other user’s.
Content Accuracy: While we require users to post accurate information, Vicipe does not guarantee the accuracy, completeness, or usefulness of any content on the platform . Recipes, advice, and other content may not be checked by us. User Content represents the views of the users who posted it, not of Vicipe. Use the content at your own risk – for example, if a recipe is poorly written or dangerous (say it omits a food safety step), we are not responsible for any issues that result. Always exercise judgment, especially when it comes to cooking methods, allergens, or health-related information. Any reliance you place on content from Vicipe is strictly at your own risk. If in doubt, consult additional sources.
No Professional Advice: If any content on Vicipe could be considered medical, nutritional, fitness, or other professional advice, note that it is provided for informational purposes only and is not a substitute for professional advice. For instance, nutritional information on recipes is not guaranteed to be accurate; consult a dietitian or doctor for health decisions. Likewise, any information provided by an AI or another user is not vetted by a certified professional unless explicitly stated. You should not rely on the Service for important decisions – for example, business, health, or safety decisions – without consulting appropriate independent professional guidance .
Operational Disclaimers: We do not warrant that the Service will be secure or free from viruses or other harmful components . Though we take security seriously, any data transmitted through the internet inherently carries some risk. You are responsible for having appropriate anti-virus software and for keeping your account secure (as discussed). Vicipe is not responsible for third-party services you use in conjunction with our platform (e.g., your internet provider, your device’s OS, or a payment processor’s service).
Third-Party Links and Services: Content on Vicipe may include links to third-party websites or services (for example, a user might link to their personal blog or a YouTube video). We make no warranty and assume no responsibility for third-party sites or services. If you visit an external link from Vicipe, you do so at your own risk. Those third-party terms and privacy policies would apply, not ours. Likewise, if our Service integrates any third-party features (such as a social media sharing button, or a map service for locating cooking classes), those are provided without warranties by us – any issues arising from them are between you and the third-party provider.
Beta Features: From time to time, Vicipe may offer new features in beta (testing) mode. These might be labeled "Beta", "Pilot", "Preview", or similar. Such features are experimental and provided without any warranties whatsoever. They may be buggy or change before full release. Use beta features only if you are willing to accept potential issues.
Jurisdictional Note: Some jurisdictions do not allow the exclusion of certain warranties. If such laws apply to you, some of the above disclaimers may not fully apply – in that case, Vicipe’s warranties are limited to the minimum legally permitted. However, in no event do we provide any warranty beyond what is legally required.
Limitation of Liability
To the maximum extent permitted by law, Vicipe and its affiliates, officers, employees, agents, partners, and licensors (collectively, “Related Parties”) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to use) the Service . This holds true whether the claim is based in contract, tort (negligence, for example), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. In simple terms, if something goes wrong while using Vicipe – for example, you lose money, or you’re upset by something – our liability to you is very limited.
Cap on Liability: In all cases, Vicipe’s and its Related Parties’ total cumulative liability to you for any claims arising from or related to the Service is limited to the greater of: (a) the total amount of fees you have paid to us in the twelve (12) months immediately prior to the event giving rise to the liability; or (b) USD $50 (fifty U.S. dollars) if you have not paid us anything in that period . If applicable law does not allow limitation to $50, then we will limit to the smallest amount it does allow. This means if you have not paid anything to Vicipe (which is likely for free users), our liability is capped at $50. If you have paid $100 in subscription or commission fees over the last year, our liability might cap at $100 in that scenario. We set these limits because, given that the Service is largely provided for free to users, it is not feasible for us to accept unlimited liability.
Exceptions: We do not seek to limit liability that cannot legally be limited or excluded. For example, in some places liability for personal injury or death caused by negligence cannot be limited; likewise, some jurisdictions might not allow limitation of liability for gross negligence or intentional misconduct. Similarly, any liability under an express guarantee that is legally required (like certain consumer product warranties) is not excluded. Also, if you reside in an EU member state, we do not purport to exclude liability for willful misconduct or fraud. The limitations above do not apply to any liability that cannot be excluded or limited under law (and any such liabilities are governed by the applicable law). Subject to the foregoing, all other liabilities are excluded or limited as provided above, even if that results in you not being fully compensated for your losses.
By using the Service, you acknowledge that the limitations of liability in these Terms are reasonable. Vicipe is a platform with many users and we could not offer it (especially not for free or at low cost) if we exposed ourselves to vast legal risk. If you do not agree that these limitations are reasonable, you should not use Vicipe.
Release: To the extent permitted by applicable law, you release Vicipe and Related Parties from responsibility, liability, claims, demands, and/or damages (actual and consequential) of every kind and nature, known and unknown, arising out of or related to disputes between users or between a user and a third-party in connection with the Service. For example, if you have a falling out with another user or you believe someone’s recipe caused you harm, that is a matter between you and that user – you release us from liability for that. If you are a California resident, you waive California Civil Code §1542 (which says you can't release unknown claims) or any similar law of another jurisdiction, meaning you explicitly waive any protections that would otherwise limit this release to known claims.
Indemnification
You agree to indemnify, defend, and hold harmless Vicipe and its Related Parties from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) that arise out of or relate to: (a) your use or misuse of the Service; (b) any User Content you post or activities you engage in on Vicipe; (c) your violation of these Terms or of any law or regulation; or (d) your infringement of any rights of a third party . This indemnity covers, for example, situations where someone else sues Vicipe because of something you did. If you posted a recipe that included someone’s trademarked name in a way that infringed their trademark and they sue us, or if you defame someone in a comment and they take legal action, or if you use the Service in a way that gets us in trouble with law enforcement – in all such cases, you agree that you will step in to defend Vicipe and pay any amounts in settlement or judgment.
Under this obligation, you will promptly assume the defense of any such claim with counsel reasonably satisfactory to us, if we request. We reserve the right to participate in the defense with our own counsel (at our expense) and to approve any settlement. You may not settle any claim that involves a remedy other than money (like an injunction against Vicipe) without our prior written consent. We will use reasonable efforts to notify you of any such claim as soon as we become aware of it, but any failure to notify immediately does not relieve you of your indemnification duty except to the extent you are materially prejudiced by that failure.
This indemnification obligation will survive the termination of your relationship with Vicipe (meaning even after you stop using the Service or delete your account, if an issue arises later that stems from your time using Vicipe, you still have to indemnify us).
In plain language: If you do something on Vicipe that causes us to get sued or suffer other costs, you’ll cover those costs. This is a standard clause to protect platforms from user-caused legal issues . We encourage users to behave in a way that never triggers this clause!
Governing Law and Jurisdiction
Vicipe is a global service, but for legal purposes we need to specify the governing law and forum for disputes. Except to the extent otherwise required by applicable law (such as local consumer protection laws), these Terms and any dispute or claim arising out of or in connection with these Terms or your use of the Service will be governed by and construed in accordance with the laws of England and Wales (if the company operating Vicipe is based in the UK; Note: we would specify the company’s home jurisdiction here), without regard to its conflict of law principles. In other words, we pick one set of laws to apply to our agreement (to avoid the confusion of different laws from every country). If you are accessing the Service from another country, you still agree that English law will govern any disputes except where a different law cannot be waived. For example, if you are a consumer in France, certain French consumer protection laws might give you rights that this clause cannot override – in such case, those rights remain intact, and this governing law clause applies to the maximum extent permissible.
Jurisdiction and Venue: All disputes arising under or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales (specifically, the courts located in London, UK, unless we specify a different city) except that we may seek injunctive relief for intellectual property infringement or other urgent legal matters in any appropriate jurisdiction. You and Vicipe consent to the personal jurisdiction of these courts , meaning you agree that London courts (as an example) have authority over you for litigation related to these Terms. You also waive any objections to venue (i.e., you won’t argue the court is inconvenient or improper). If you are a consumer residing outside of this chosen jurisdiction, you might have the right to bring claims in your home country’s courts under certain consumer laws – nothing in these Terms is meant to strip you of such non-waivable rights, but to the extent you can agree to a forum, you agree to the one stated here.
Local Law Exceptions: We acknowledge that laws vary globally. If any provision of these Terms is illegal or unenforceable under the laws of your country of residence, that provision shall be severed (removed) from these Terms for you to the extent necessary, and the rest of the Terms will remain in effect . For example, if a certain disclaimer or limitation is not allowed by local law, that particular clause won’t apply to you, but everything else still will, and an equivalent permitted protection (if any) shall be deemed substituted. Also, if your country’s laws require certain terms to apply (for instance, some countries have mandatory warranties or cancellation rights), then those laws will be read into these Terms.
Timing of Claims: You agree that any claim or cause of action arising out of or related to the Service must be filed within one (1) year after such claim or cause of action arose, or else it will be permanently barred . This is a limitation period shorter than what some laws might allow, but it reflects that issues should be raised promptly. (Again, if your local law prohibits shortening the statute of limitations, then this clause may not apply to you, but it will to the extent permitted.)
Dispute Resolution; No Class Actions: Before filing a lawsuit, we strongly encourage you to contact us to discuss and hopefully resolve any issue. Often, customer support can fix problems without needing formal legal action. If litigation does occur, it will be on an individual basis. You and Vicipe waive the right to a trial by jury and agree that any proceedings will be conducted only on an individual claim basis, not as a class action or similar representative action. That means you cannot bring a claim on behalf of a group or the public, and similarly we cannot consolidate your claim with others. (If this class action waiver is unenforceable in your jurisdiction, then it shall not apply, but the rest of this section still does.)
We want to highlight that nothing in this Governing Law section is intended to limit the rights of consumers under law. Some countries’ laws give consumers the right to have disputes governed by their local laws and heard in their local courts (for instance, EU residents might be able to sue in their home country under EU law despite a contract saying otherwise). We will of course respect such laws. This section mainly applies to matters that are not mandatorily dictated by local law.
Changes to the Terms and Service
Modification of Terms: Vicipe may modify these Terms from time to time. We will provide notice of material changes (for example, by emailing users or posting a prominent notice on the site) and update the “Last Updated” date at the top. It is your responsibility to review any updated Terms. The updated Terms will become effective no sooner than 14 days after they are posted, except changes addressing new functions of the Service or changes made for legal reasons may become effective immediately. If you continue to use Vicipe after the effective date of any revised Terms, that means you accept and agree to the changes. If you do not agree to the updated Terms, you must stop using the Service before they take effect and, if applicable, delete your account. We value our users and will usually give a heads-up about major changes, but we reserve the right to update Terms as needed to adapt to changing circumstances (technology, laws, business practices, etc.). Always feel free to reach out if you have questions about any change.
Modification of the Service: Vicipe is an evolving platform. We may add, remove, or change features and functionalities. We may also discontinue (temporarily or permanently) parts of the Service. For example, we might launch a new feature in beta and later remove it if it doesn’t work out, or we might change the way our search or algorithm works, or discontinue a particular content category. We may not always be able to inform users before a change or discontinuation, but when feasible, we try to give advance notice (especially for something like shutting down a significant feature). You acknowledge that Vicipe has no obligation to maintain any particular part of the Service or to support older devices or browsers. If you are on an outdated app version, some functions might stop working until you update. We also won’t be liable to you or any third party for any modification, suspension, or discontinuation of the Service – e.g., if we shut down our messaging feature and you lose messages, or if we sunset the entire platform, we aren’t liable for the consequences beyond what any law requires.
Beta and Testing: Sometimes we let a subset of users test new features (A/B testing, beta programs, etc.). Those features might not be available to everyone and could change or be removed at any time. Participating in a beta doesn’t guarantee the feature will become permanent or that you will have access indefinitely.
Miscellaneous
Entire Agreement: These Terms (along with any additional terms we provide for specific services, features, or promotions, and our Community Guidelines, Privacy Policy, Monetization Terms, and other referenced documents) constitute the entire agreement between you and Vicipe regarding your use of the Service . They supersede any prior agreements or communications (whether oral or written) between you and us regarding the subject matter. Any additional documents like order forms or separate agreements for paid services (if any) will take precedence over these Terms in the event of a conflict, to the extent specified . If you and Vicipe have separately signed a written agreement (for example, a brand partnership contract), that agreement’s terms would also govern to the extent of any conflict with these general Terms.
No Waiver: If we do not immediately take action on a violation of these Terms, it does not mean we are waiving (giving up) any rights . For instance, if you violate the Terms and we don’t act right away, we can still take action later for that violation or any subsequent violation. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Vicipe.
Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions of the Terms will remain in full force and effect . In legal terms, we’d interpret the Terms in a way to best carry out the intent within lawful bounds. For example, if a court said the liability cap is too low to be enforceable, it might modify it to a higher minimum or remove it, but everything else remains enforceable.
Assignment: Vicipe may assign or transfer these Terms, or any of its rights or obligations under them, in whole or in part, to any person or entity at any time without your consent . (For instance, if Vicipe is acquired by another company or if we need to transfer contracts to an affiliate.) You may not assign or transfer any rights or obligations under these Terms to anyone without our prior written consent; any attempt to do so without consent is void.
